1. Who we are

Brainy Bites is operated by Thomas (sole proprietor, based in South Africa), trading as "Brainy Bites" ("we", "us"). We provide an AI-powered quiz generation service available at brainybitesapp.app. By using the service you are entering into an agreement with Thomas trading as Brainy Bites. You can reach us at Brainybites@edu-wise.app.

2. Acceptance

By creating an account or continuing to use Brainy Bites you agree to these Terms.

3. What we provide

Brainy Bites turns text, PDFs and images you supply into quiz questions using large language models. Free and paid plans are described on our pricing page.

4. Acceptable use

You agree not to:

• Use the service for any unlawful purpose, fraud, spam or abuse.
• Infringe anyone's intellectual property or privacy rights.
• Probe, scan, scrape, or interfere with the security or integrity of the service.
• Generate hateful, harassing, sexual content involving minors, malware, or content that promotes self-harm or violence.
• Attempt to jailbreak, reverse-engineer, or extract the underlying models or prompts.

5. AI output disclosure

Quiz output is generated by an AI model and may contain inaccuracies. You are responsible for reviewing output before relying on it, especially for academic, medical, legal, safety, or other regulated use. Brainy Bites is not a substitute for professional advice.

6. Your content

You retain ownership of the source material you upload. You grant Brainy Bites a limited license to process that material solely to generate quizzes for you. You confirm you have the right to upload and use the material you provide. If you believe content on the service infringes your rights, contact us so we can investigate and remove it.

7. Account

You must keep your credentials confidential and provide accurate information. You are responsible for activity under your account.

8. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by the Paddle Buyer Terms and our Refund Policy.

Paid subscriptions renew automatically each billing period until cancelled. You can cancel at any time from your Account page.

9. Intellectual property

Brainy Bites and all related software, branding, and documentation are owned by us and our licensors. We grant you a limited, non-exclusive, non-transferable right to use the service within the limits of your plan. You may not resell, redistribute or circumvent technical limits of the service.

10. Service availability

We do not guarantee uninterrupted or error-free service. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

11. Suspension and termination

We may suspend or terminate access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated policy violations. On termination, you may export any data you have stored for a reasonable period before deletion.

12. Liability

To the fullest extent permitted by law, our aggregate liability for any claim arising from these Terms is capped at the fees you paid us in the 12 months preceding the claim. We exclude liability for indirect, consequential or special damages, including loss of profits, data or goodwill. We do not exclude liability for fraud, death or personal injury where the law prohibits doing so.

13. Indemnity

You will indemnify us against claims arising from content you upload, your unlawful use of the service, or your breach of these Terms.

14. Changes

We may update these Terms. Material changes will be communicated by email or in-app notice before they take effect.

15. Governing law

These Terms are governed by the laws of the Republic of South Africa. The courts of South Africa have exclusive jurisdiction over any dispute, subject to any mandatory consumer-protection rights you have in your country of residence.
